CENTRAL PACIFIC BANK’S SHAKA KALIKIMAKA! SWEEPSTAKES

1) ELIGIBILITY: The Central Pacific Bank’s Shaka Kalikimaka (“Sweepstakes”) is open to legal U.S. residents of the State of Hawaii, eighteen (18) years of age or older. This Sweepstakes is void where prohibited and is subject to applicable federal, state, and local laws and regulations. Employees of Central Pacific Bank, its parent company, affiliates and subsidiaries, and those living in the same household, are not eligible to win in this Sweepstakes.

2) SPONSOR: The Sponsor of this Sweepstakes (“Sponsor”) is Central Pacific Bank, 220 South King Street, Honolulu, HI 96813, Member FDIC.

3) HOW TO ENTER: NO PURCHASE OR TRANSACTION IS NECESSARY TO ENTER. A PURCHASE OR TRANSACTION WILL NOT INCREASE YOUR ODDS OF WINNING.

The Sweepstakes begins at 12:00AM Hawaii Standard Time (“HST”) on 11/26/2021 and ends at 11:59PM HST on 12/25/2021 (“Sweepstakes Period”) and consists of four entry periods (each “Entry Period”) as outlined in the table in paragraph 5 below. There are two (2) methods of entry as follows

3a) Enter the Sweepstakes by opening a Shaka Checking account during contest period – Participants will receive one entry for opening a Shaka Checking account during the Contest Period, with the exception of the week 4 giveaway which will be open to all current Shaka account holders. Accounts must be successfully approved and opened during the contest period (or since Shaka’s launch on November 8, 2021 for the week 4 giveaway) to qualify. Pending or denied accounts will not qualify as an entry. Entries will be limited to one per eligible customer.

3b) To enter the Sweepstakes without opening a Shaka Checking Account – Participants may submit an entry into the Sweepstakes during the applicable Entry Period by handwriting their full name, complete mailing address, telephone number, email address, date of birth and the words “Central Pacific Bank Shaka Kalikimaka” on a plain 3” × 5” piece of paper and mailing it in a sealed and stamped #10 envelope to: Central Pacific Bank, ATTN: Marketing, PO Box 3590, Honolulu, HI 96811. Mail-in entries are limited to one entry per participant during Sweepstakes Period. Mail-in entries missing any information requested will automatically be disqualified from the Sweepstakes. Mail-in entries must be received by Sponsor during the Sweepstakes Period to receive an entry in the Sweepstakes.

Sponsor reserves the right in its sole and absolute discretion to disqualify any entry it deems incomplete, incoherent, illegible, inappropriate or abusive.

Sponsor is not responsible for entries which are lost, late, stolen, incomplete, illegible, inaccurate, undelivered, delayed, misdirected, or cannot be completed due to electronic or technical difficulties, regardless of cause.

4) SELECTION FOR WINNERS: For each Entry Period, the below prizes will be awarded by random drawing among all eligible entries received during the noted entry period. Drawings will be conducted by the Sponsor, whose decisions will be final and binding in all matters relating to this Sweepstakes. There will be four (4) winners total; one (1) winner each week between November 26 through December 25. The Grand Prize on week 4 (Christmas week) will be double the prize amount as that of the previous weeks ($10,000), and all current Shaka account holders will be eligible for the week 4 giveaway. Previous prize winners will be ineligible for other prizes. The number of finalists may change under the Sponsor’s discretion. The potential prize winners will be notified by the Sponsor via telephone or email (method selected at Sponsor’s discretion. Subject to verification of eligibility and compliance with these Rules, the potential winners will be declared the official winners of the Sweepstakes. Winners have the right to decline to accept any prize they are selected to win without any obligation. Winners have only three (3) business days from the Sponsor’s calls and emails to claim their prize. Unclaimed prizes will be forfeited, and the Sponsor has the right to randomly redraw for another potential winner until a prize is claimed. Limit one (1) prize per person, immediate family member or household. Odds of winning will depend on the total number of eligible entries received for each applicable Entry Period as described in the Section 3 “How To Enter” above.

5) PRIZES: Four (4) total Prizes; one (1) of which will be the grand prize of $10,000.

The Approximate Retail Value (“ARV”) of the prizes is based on available information provided to the Sponsor and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner may be required to provide Sponsor with a valid social security number before the prizes will be awarded for tax reporting purposes. An IRS Form 1099 may be issued in the name of each winner for the actual value of the prizes received. Prize money will be deposited directly into the winner’s Shaka account. Those without Shaka accounts will receive payment via check.

Total ARV of all prizes awarded in this sweepstakes: $25,000.

WEEKLY PRIZES

Prize is non-transferable and no substitutions are allowed except at the sole discretion of the Sponsor, which reserves the right to substitute a prize with one of comparable or greater value. For joint account holders, the prize will be awarded to the primary account owner. Winner will be solely responsible for payment of any taxes and fees associated with the prize

6) WINNER NOTIFICATION: Each potential winner will be notified by Sponsor either by email or telephone based on information in the Sponsor’s database or on the Sweepstakes entry and be given instructions on how to contact Sponsor through email to claim prize. The winner must reply to the winner notification from Sponsor and include the telephone number, mailing address and email address of the winner within three (3) business days of Sponsor sending notification. Winner(s) may be required to complete and sign an Affidavit of Eligibility and Liability Release, and where legal, a Publicity Release, and IRS Form W-9, all of which must be returned within 14 days from date of issuance thereof or the prize will be forfeited and awarded to an alternate winner. If a winner is not reachable at the telephone number, mailing address or e-mail address provided and a forwarding mailing address or e-mail address is not made available or if prize notification is returned as undeliverable, then the prize will be forfeited, and an alternate winner may be selected. Determinations made by Sponsor are final on all matters relating to the Sweepstakes.

7) TERMS & GENERAL CONDITIONS: By entering this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of Sponsor. Entrants agree that this Sweepstakes is governed by the laws of the State of Hawaii without regard to its principles of conflicts of law. As a condition of entering the Sweepstakes, participant agrees that: a) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; b) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and c) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes if it is not capable of running as planned and award prizes from among all eligible entries received prior to cancellation. Sponsor reserves the right to terminate or modify these Official Rules at any time, without cause or prior notice, and to interpret these Official Rules and make decisions regarding the interpretation of these Official Rules at any time in its sole and absolute discretion.

8) RIGHTS GRANTED BY SWEEPSTAKES PARTICIPANTS: By entering the Sweepstakes, entrants grant the Sponsor and each of its affiliates the right to use their name, address and/or likeness for publicity and promotional purposes relating to the Sweepstakes without further compensation, notice or consent, in any and all forms of media, unless prohibited by law.

9) LIMITATION OF LIABILITY: By entering the Sweepstakes, entrants agree to release and hold harmless the Sponsor and Instagram, and Facebook, and each of their parent companies, subsidiaries and affiliates, advertising and promotion agencies, its affiliates, and all of their respective agents, representatives, officers, directors, shareholders and employees from and against any claim or liability for any bodily injury, loss, cost or damages of any kind to persons, including death and property, damages sustained due in whole or in part, directly or indirectly, from the creation of an entry including any and all claims for copyright infringement, invasion of privacy, violation of the right of publicity or defamation, the acceptance, possession, use or misuse of the prize or parts thereof, if applicable, or participation in the contest or participation in any contest or related activity.

All verified and certified winners will be posted to the official Central Pacific Bank Instagram. Facebook. Twitter, and LinkedIn accounts by January 1, 2022 or within 10 days after all prizes are claimed, whichever is the latter, that affirms all prizes were given away as outlined herein and that, the Sponsor has certified the process was executed within the rules as prescribed.
